Aviation reform with airline for the government is approved in fast track

The majority of Morena and allies in the Chamber of Deputies approved the reform of the Civil Aviation Law on fast track, which seeks to provide the government with tools to recover category 1 aviation and establishes the bases to create an airline of the State.

At the beginning of the session, legislators from Movimiento Ciudadano and Partido de la Revolución Democrática presented motions to stop the debate, arguing that each proposed change needs to be analyzed in detail.

The final vote was 256 votes in favour, 219 against and 0 abstentions. The matter will go to the Senate of the Republic to continue the legislative process.

Changes in detail

The opinion reforms the Airports Law and the Civil Aviation Law in matters of Category 1 aviation and establishes the bases to create a State airline.

The reform seeks to approve powers to the Federal Civil Aviation Agency to issue technical-administrative regulations on airport matters.

Defines the AFAC as a decentralized administrative body of the Ministry of Infrastructure, Communications and Transport.

It may issue provisions related to the administration, operation, construction and certification of civil airports and aerodromes, as well as master development programs, indicative programs of investments, airport and complementary services.

The reform seeks to authorize government parastatal entities to be assigned the administration of airports and the operation of airlines.

The reform seeks to strengthen the security of the civil aviation and authorize the AFAC to carry out the administrative investigation related to accidents and incidents, to determine the corresponding administrative responsibilities.

The minimum and maximum amount will be raised to sanction concessionaires or permit holders that do not comply to the itineraries, flight frequencies and authorized schedules.

It will penalize the concessionaires, permit holders, airport operators and technical-aeronautical personnel who violate the provisions related to civil aviation medicine.
